Dominic is a junior barrister who specialises in chancery and commercial law, with a particular interest in all aspects of property and wills and probate. As well as his 6 years of experience at the specialist bar, Dominic had 4 years prior experience at an international law firm during which time he practised as a solicitor in the commercial litigation department.

Dominic is the Chancery Bar Association’s representative on the North-eastern Circuit and, as such, sits on the national committee of the ChBA. of the Northern Chancery Bar Association and the Property Bar Association. current case load includes residential and commercial property disputes concerning adverse possession, easements, boundaries and covenants as well as disputes over co-ownership of land and applications under the Trusts of Land and Appointment of Trustees Act 1996. Dominic has a special interest in disputes over registered land which are referred to the Adjudicator to HM Land Registry and he is the author of a forthcoming book on the Adjudication process. He was counsel in the recent case of Bernice Thomas v Clydesdale Bank Plc (t/a Yorkshire Bank) [2010] EWHC 2755 (QB) (Ramsey J) which clarified the construction of ‘actual knowledge’ under paragraph 2(c) (ii) of Schedule 3 to the Land Registration Act 2002.

Dominic’s wills and probate expertise encompasses disputes over the validity of wills, applications for removal or substitution of personal representatives, claims for the restitution of estate property and solemn form probate claims. He has acted in many claims under the Inheritance (Provision for Family and Dependants) Act 1975 and has also undertaken drafting work in the field of wills and probate. Recently Dominic has been developing a practice in the Court of Protection.

The other major component of Dominic’s practice is commercial work, including contract and tortuous claims, sale of goods, debt, and claims for return of goods.

Dominic particularly relishes the opportunity to become involved in a case at an early stage, providing advice on how the case should be prepared and litigation tactics. He is a firm advocate of the policy of “thinking trial from day one” in order to get the best result for the client.

DOMINIC CROSSLEY PUBLISHES BOOK ON LAND REGISTRY ADJUDICATION
Dominic Crossley has recently published a book on proceedings before the Adjudicator to HM Land Registry, a judicial office which is assuming ever greater importance in the field of real property disputes since its establishment by the Land Registration Act 2002. The book deals not only with the procedure before the Adjudicator, guiding practitioners through what is still for many an unfamiliar process, but also contains chapters on the most common areas of property law likely to arise in Adjudication proceedings.
