Director disqualifications

Shakil is regularly instructed in relation to all aspects of both corporate and personal insolvency including administrations, administrative and other receiverships, liquidations, bankruptcies, company and individual voluntary arrangements, the adjustment of antecedent transactions, recovery of corporate assets and misfeasance claims.

Shakil is also instructed in directors’ disqualification proceedings both on behalf of directors and the Secretary of State (having been appointed Junior Counsel to the Crown in 2010).

In recent years Shakil has gained significant experience in judicial review claims.

Recent instructions include:
  • Representing an Administrator in litigation involving a group of over 100 investors;
  • Representing an Administrator on an application by a creditor for an injunction restraining the sale of the company’s business and assets;
  • Representing a Liquidator in high value antecedent transaction claims and claims for wrongful trading and misfeasance;
  • Representing the Supervisor of an IVA on an application by a creditor to set aside the IVA for material non-disclosure and procedural irregularity;
  • Representing directors in a two week directors’ disqualification trial involving serious allegations of financial impropriety and dishonesty;
  • Representing the Secretary of State in directors’ disqualification proceedings against a German national involved in assisting foreign nationals in obtaining bankruptcy orders in the UK;
  • Representing the Home Office in a four day judicial review hearing involving complex issues as to the proper interpretation of European Directives and their compatibility with domestic legislation;
  • Being led in a judicial review claim by an overseas company against the Secretary of State for Business Innovation and Skills.
